FTC’s public comment window on AI ‘accuracy’ policy closes this week

The Federal Trade Commission’s public comment period on a proposed policy statement concerning the suppression of accuracy in artificial intelligence systems is set to close July 31, the final stretch of a review the agency opened earlier this summer. The proposed statement lays out the FTC’s view that AI companies who deliberately distort their systems’ outputs to pursue undisclosed ideological objectives, rather than the accuracy and objectivity a reasonable consumer would expect, could be engaging in a deceptive practice under Section 5 of the FTC Act, the agency’s core consumer protection authority. Comments submitted before the deadline will be posted to Regulations.gov once processed, and the FTC has not indicated a timeline for finalizing the statement afterward. The proceeding sits alongside a broader wave of US and state level activity this summer aimed at how AI systems are built and disclosed, from California’s AI Transparency Act taking effect August 2 to Colorado’s replacement AI framework arriving in January, and reflects an effort by federal regulators to use existing consumer protection law to reach questions about model behavior that Congress has not yet addressed directly through new legislation.
